TERMS AND CONDITIONS OF SERVICE

1. INTRODUCTION AND PARTIES
These Terms and Conditions govern the use of the website and the booking of services offered by SURF LT, a Limited Liability Company (LLC) registered in the State of Wyoming, United States (hereinafter, “the Company”, “we”, “us”, or “our”). By booking any service with us, the client (hereinafter, “the User” or “the Client”) fully accepts these conditions.
2. NATURE OF THE SERVICES
The Company offers two distinct types of services:
A. Surf Trips and Experiences (Acting as Intermediary): For travel packages (which include accommodation, third-party activities, restaurants, etc.), the Company acts exclusively as an intermediary and payment mandate. The Client hires us to facilitate the booking and process payments on their behalf to local providers (hotels, surf schools, transport). The actual service contracts are made directly between the Client and the local providers.
B. Private Coaching: Independent surf instruction services provided locally.
3. PAYMENT AND CANCELLATION POLICY
For Surf Trips and Experiences (Packages):
Due to the necessity of securing spots and paying local providers in advance, our cancellation policy is strict:
Cancellations made more than 3 months (90 days) prior to the start date: 100% refund of the amount paid (minus any banking or payment gateway fees).
Cancellations made between 3 months (89 days) and 2 months (60 days) prior to the start date: 50% refund of the total trip amount.
Cancellations made less than 2 months (59 days) prior to the start date: No refund will be issued (0%).
Important Note: No exceptions or refunds will be made for medical emergencies, force majeure events, flight issues, or personal reasons. To cover these eventualities, we require the purchase of a comprehensive travel insurance policy (see section 4).
For Private Coaching:
Currently, payment for private coaching is made on-site at the time of the service. Since there are no upfront payments, refund policies do not apply. If you are unable to attend, we kindly request at least a 24-hour notice.
4. MANDATORY TRAVEL AND MEDICAL INSURANCE
Surfing and related activities are action sports that carry inherent risks. It is STRICTLY MANDATORY that all Clients participating in our trips or classes have a valid Travel and Medical Insurance policy that explicitly covers surfing activities and medical repatriation. The Company reserves the right to request proof of the insurance policy before the activities begin and to deny participation (without the right to a refund) to anyone who fails to provide it.
5. LIMITATION OF LIABILITY AND ASSUMPTION OF RISK
By booking our services, the Client acknowledges and assumes the risks associated with surfing and international travel.
For “Surf Trips and Experiences”, the Company is not liable for any injuries, damages, losses, delays, or accidents caused by local providers (third-party surf schools, hotels, transport companies). Any claims must be directed to the final service provider.
The Client releases, waives, and discharges [YOUR BRAND OR LLC NAME], its directors, employees, and partners from any civil, criminal, or financial liability arising from accidents, physical injuries, or death during the activities.
6. MEDIA RELEASE (IMAGE RIGHTS)
During the trips and classes, the Company or its partners may take photographs and record videos of the Clients for technical analysis (coaching) and promotional purposes. By accepting these terms, the Client grants the Company express and royalty-free consent to use their image, voice, and likeness on social media (Instagram, Facebook, YouTube, TikTok), our website, and marketing materials, without geographical or temporal limitations. If a Client does not wish to be recorded or photographed, they must notify us in writing before the services begin.
7. GOVERNING LAW AND JURISDICTION
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions or the services provided shall be governed by and construed in accordance with the laws of the State of Wyoming, United States. The parties expressly submit to the exclusive jurisdiction of the courts of said State.
